(Sept 2016) United Kingdom: Preschool owner, Mary Staniforth, 32, found guilty of starving her dog nearly to death

UNITED KINGDOM -- Marie Elizabeth Staniforth, who owns Acorns Pre-School in Cleator Moor, appeared before magistrates in a two-day trial, accused of causing unnecessary suffering to a protected animal between January and February this year.

Staniforth, 32, denied the charge, but was found guilty.

West Cumbria magistrates gave her an 126-day sentence, banned her for life from keeping an animal and ordered her to pay a £281.70 donation to the RSPCA and an £80 surcharge.

Staniforth can appeal the ban after 10 years.

Joan Singleton, owner of Fairview Boarding Kennels, told the trial she received a call on February 16 from someone claiming to have found a stray lurcher-type dog on an industrial estate in Cleator Moor.

The court heard the woman had given Staniforth’s mobile phone number and her address in Highfield Road, where the dog was collected from.

Martyn Fletcher, an RSPCA inspector with 17 years’ experience, told the court he had never seen a dog so thin survive.

He said: “It was clearly in a very emaciated condition. It was standing up but was very wobbly and weak on its feet.”

The dog was treated by Millcroft Veterinary Group before being rehomed.

Mr Fletcher told the court he visited the house where the dog was collected to try to speak to the finder but received no reply but spotted a dog cage containing what he believed to be two or three-day-old feces outside.

The court heard the RSPCA launched an appeal to trace the dog’s owner and received about 30 replies, about 25 of which identified Staniforth as the owner or the address, where the defendant had lived, as its home.

Staniforth, now of Gatesyde Place, Eskdale Green, Holmrook, was cautioned and interviewed by Mr Fletcher in March and said the dog, called Charlie, had gone missing during a walk on January 24 and she was not responsible for its condition.

But Hayley Dawkins, a community nurse, told the court she had called at the house on February 3 and noticed a dog matching Charlie’s description in the porch.

Staniforth said she had returned to the route she normally walked the dog to look for him, but without success.

After the hearing, Mr Fletcher said: "There are never winners in situations like this, we are here because an animal has suffered cruelty.

"Families have lives disrupted but animals come with responsibility and if you don't take that responsibility, there are consequences. It sends a strong message.

"Joan Singleton, who initially got the dog in February, has in my mind undoubtedly saved its life.

"There's always help for people if they get into difficulty caring for animals and the RSPCA and other organisations are there to help them.

"The dog is doing really well now and is in a nice place with other dogs."

Tennessee: Illegal aliens Luis Mendoza, Francisco Flores and Hector Mendoza await criminal court after beating, torturing and stabbing dog

TENNESSEE -- The health of Smokey the German shepherd is improving every day. The future may not be so bright for three men accused of severely abusing the animal.

The defendants charged with felony counts of aggravated cruelty to animals, 32-year-old Francisco Pultarco Flores, 27-year-old Luis Hernandez Mendoza and 25-year-old Hector C. Mendoza, had preliminary hearings scheduled Wednesday in General Sessions Court.

The men waived their hearings, and evidence in the case will be presented to a Greene County grand jury. Judge Kenneth Bailey Jr. set Nov. 30 Criminal Court appearance dates for Flores and the Mendozas.

In addition to aggravated cruelty to animals, the men are also charged with vandalism over $500 and theft over $500 in connection with the case.

Bailey told citizens who came to court looking for punishment for the defendants that the earliest Flores and the Mendozas will go to trial would be January 2017.

The information was relayed to the defendants through interpreters.

The attack on the 7-year-old German shepherd happened Aug. 14 inside the men's apartment in the 7900 block of Asheville Highway. It was interrupted by sheriff's deputies investigating a drunk and disorderly call. Deputies arrived just in time to save the dog's life, Greeneville-Greene County Humane Society representatives said.

Smokey is back at home with his owners, Elaine and Lester Darnell, and his wounds are healing, the couple said Wednesday outside the courtroom.

The three defendants are not U.S. citizens. Their status in this country is being investigated by immigration officials, Sheriff Pat Hankins said.

Update: Confirmed they are all three Mexican illegal aliens.

It's still not known why the dog was attacked in a bathroom in the apartment where the men lived.

"I think it's just sickening that anybody would be that cruel to an animal. I don't understand why anybody would do that," Hankins said.

ATTACK ON DOG
Smokey lives on White Sands Road with the Darnells. When a thunderstorm blew in on the night of Aug. 14, they were not home. Elaine Darnell said she and her husband returned to put Smokey inside the house because he is afraid of storms, but the dog had already jumped a fenced-in enclosure.

Smokey apparently ran about a quarter-mile to the 7900 block of Asheville Highway, where he encountered Flores and the Mendozas.

As deputies entered the apartment, they saw the three men in a rear bathroom, a report said.

When deputies opened a bedroom door, the three men turned toward them and a "shepherd- to medium-size dog came running from the bathtub," the report stated.

The dog "had several cuts and punctures about its body," the report said.

"One of the males was holding a bloody knife and the other was holding a long wooden stick, both being stained with blood," it added.

Smokey had several cuts and punctures to his body. He had been beaten, stabbed repeatedly in the face, neck and body while trapped in the bathroom with the three men.

Blood was all over the floor of the apartment’s bathroom - it looked like a murder scene.

According to sheriff's department, the theft charge relates to the men "taking control" of the 7-year-old dog, which is valued at more than $500 and is the property of the Darnells, who have been nursing him back to health with the help of Dr. Hope Fann, the veterinarian who has been treating Smokey since the night of Aug. 14.

The vandalism charge relates to the physical damage done to the dog.

ANIMAL ADVOCATES
At least 10 people were in the courtroom Wednesday afternoon to urge the court to prosecute Flores and the Mendozas to the full extent of the law. Bailey explained that since the men are charged with felonies, they could not enter guilty pleas in General Sessions Court. The charges will be resolved in Criminal Court after evidence is presented to a grand jury.

The Darnells and Fann were among those in the courtroom.

Elaine Darnell said she and her husband will let the legal system run its course.
"The officer explained how this works and that they waived their rights (to a preliminary hearing) so we kind of expected it," she said.

Smokey's stitches were removed Monday "and some of his hair is growing back," Darnell said.

After he was injured, Smokey had drainage tubes placed in his head and neck area, along with stitches applied to close multiple lacerations and cuts.

"Smokey seems to be doing well physically from his check-up appointment," Fann said.

Several Humane Society representatives were also in court, including Amy Bowman, shelter manager who took Smokey to the Greene County Veterinary Medical Center where he was treated by Fann the night he was wounded.

'JUSTICE FOR SMOKEY'
"The main thing is we just want justice for Smokey and hopefully we will get that in January," Bowman said after the court proceeding.

Bowman was appreciative that members of the community attended the court hearing. Among them was Gypsy Tweed, who circulated a petition on Change.org signed by more than 3,000 people asking that the defendants "be prosecuted to the fullest extent of the law."

That could mean up to two years in jail for each defendant, according to the law.

"I'm not a huge rabble-rouser but I have two (rescue) greyhounds and to me, it was just blatant, brutal and horrible. It was just ill intent and mean to go to all the effort to get somebody else's dog," Tweed said. "If you get them deported, you don't know if they will serve their time and I want them to serve their time here."

Prosecutors said Flores and the Mendozas would remain in the U.S. at least until the legal process is complete.

Meanwhile, the men remain held on $17,000 bond each in the Greene County Detention Center, where they likely will remain until their cases are resolved.

Florida: Chihuahua, being walked by its owner, is attacked by Rottweiler

FLORIDA -- This is my little guy, Buddy, a 10 year old Chihuahua who weighs 8.3 pounds.

Two days ago, Buddy was viciously attacked by my neighbors Rottweiler. The dog came tearing out from his yard to the gravel road where Buddy and I were walking. The Rottweiler repeatedly bit Buddy around the neck and chest, shaking him violently and then flinging him into the air like a rag doll.

I screamed for help and tried to intervene but the Rottweiler was in a blood-thirsty frenzy. They broke apart briefly and I decided at the risk of being bitten in the face, I had to pick up Buddy or he would be dead after the next onslaught of attacks.

I picked Buddy up as the owner of the Rottweiler came out to the road and called his dog.

We rushed Buddy to the Animal ER. On the way, I could see that Buddy was going into shock from blood loss. The towel I wrapped him in and and my pants were soaked in blood. He was going limp. I prayed and said to God, "Take my house. I don't want it. Take my car. I don't want it either. Take all my clothes. They suck anyway. But leave me my dog...PLEASE!".

When we arrived at the ER, they were able to take him in right away. They put him on an IV, oxygen, and placed him in a heated chamber to raise his body temperature. In the end, he had to have his left kidney removed because it had been torn away and he received sutures for the puncture wounds in the muscle wall between his ribs from the bites. There was some internal bleeding and massive swelling and bruising but...he's alive.

Miraculously, after facing off against a 90 pound Rottweiler, my tough little Chihuahua is still alive and I'm incredibly grateful. Now that he is home resting, I'm kinda hoping God won't remember the whole bit about me saying "Take my house. I don't want it!". He can still have the clothes though. lol #PETSAREFAMILY

Melissa Rios: Oh poor Buddy! The kids & I will be praying for him & you!

Joy Peters: Glad Buddy is still with us. Praying for his speedy recovery. Please do contact animal control. They need to know people are letting their large aggressive dog run loose. And those owners should pay your bill. Good luck to you and Buddy.

MaryEllen Olson: What a sad and tragic story. I'm so sorry and hope that Buddy

Craig Stephens: How terrible!! Poor Buddy! I'm glad you're both okay. That could have gone very badly for you, too!

In North Carolina, when you hog tie your dog, throw her in a lake and watch her drown, you get 30 days in county jail and can have the whole thing wiped off your record afterwards

NORTH CAROLINA -- A Fort Bragg soldier pleaded guilty Tuesday to tying up his puppy in late 2014 and tossing it into a pond, where it drowned.

John Garrett Burrow, 24, of 440 Georgetown Circle, pleaded guilty to felony cruelty to animals.

Authorities said Burrow used military parachute cord to hog-tie Riley, an 8-month-old Lab mix, before tossing the dog into McFadyen Lake in Fayetteville.

The dog's body, still tied up with the parachute cord, washed up on the shore of the pond on Jan. 2, 2015.

Neighbors said they were outraged by the dog's death, noting that they had given Burrow and his wife hundreds of dollars after the couple claimed Riley had been injured and they couldn't afford to pay veterinary bills.

PATHETIC SENTENCE FOR ANIMAL TORTURE AND DEATH

Superior Court Judge Jim Ammons sentenced Burrow to 30 days in jail and ordered him to perform 100 hours of community service, possibly at Cumberland County Animal Control. Burrow also will spend two years on probation, during which Ammons ordered him to carry a photo of Riley in his wallet.

Burrow won't be able to own any pets for five years, as part of his plea agreement. The felony conviction will be wiped from his record if he successfully completes the terms of the deal.

His wife, Kelsey Caroline Burrow, 22, still faces a misdemeanor charge of being an accessory after the fact in the case.

If he was the main abuser and he gets just 30 days in county lockup and then can have the whole crime erased from his record.... what kind of pathetic punishment is she facing? Six minutes in county jail and then she gets to have it wiped off her record as well?

University of South Carolina-Lancaster baseball players Grant Bodison, 19, and Joshua Kiser, 19, tortured a cat to death. Dean Walt Collins says they've been "disciplined" but refuses to say what was done

SOUTH CAROLINA --Two Lancaster teens are accused of shooting and killing a cat, police say.

Lancaster police say USC-Lancaster college students Grant Payton Bodison, 19, from Simpsonville (SC) and Joshua Allen Kiser, 19, from Aiken (SC), took turns torturing and shooting a cat during a cookout at a home on John Everall Road on Sept. 10.

Do you see this? Josh Kiser is
MAJORING IN CRIMINAL JUSTICE!

Lancaster County deputies and animal control officers began investigating after receiving a tip through Crime Stoppers, according to Doug Barfield, a spokesman for the sheriff’s office.

According to the sheriff’s office incident report, the shootings happened between 4 and 6 p.m. Sept. 10 during a cookout at 1521 John Everall Road, a home shared by several members of the Lancers baseball team.

Police were told the cat had become a “nuisance” by rummaging through the garbage at the home.

So what? Keep a lid on your trash can. Call Animal control.

When the cat appeared during the cookout, Grant Bodison went and retrieved a BB gun owned by one of the home’s residents and shot twice at the cat, with at least one shot striking the cat in the forehead, the incident report said.

The report said students told investigators that after the cat was struck it began to “seize,” or “spaz,” rolling around on the ground in pain, after which Kiser took the BB gun and fired several more shots at it to “put it out of its misery.”

When that failed to kill the cat, the third student, who is also listed on the Lancers baseball roster as a player, jumped the porch railing and intervened.

“Some stated (he) attempted to strangle the cat at first, but the cat wouldn’t die, so he snapped its neck,” the incident report said.

The cat's mutilated and broken body was then dumped in a shallow grave on the property [to hide evidence of the sadistic, depraved crime they'd just committed].

The cat’s body was recovered and brought to a vet, where it was x-rayed. Images showed two BBs in the cat’s body.

The University of South Carolina-Lancaster conducted a parallel investigation, as residents of the home were students at the university, police say.

They need to be expelled

DOES THE UNIVERSITY OF SOUTH CAROLINA-LANCASTER TAKE ANIMAL TORTURE AND CRUELTY SERIOUSLY?

USCL Dean Walt Collins confirmed in a brief statement that an incident did occur off campus and that, in addition to the law enforcement investigation, the university had looked into the matter on its own.

He said the students had been disciplined, but said federal student privacy laws prevented him from discussing any details of the incident or what measures had been taken.

“USC Lancaster expects all students to adhere to high standards in both academic and behavioral integrity,” Collins said.

Collins refused to discuss the students’ status with the baseball team. Both were listed on the team roster on the USCL website Sept. 15, the night The Lancaster News first inquired about the incident. The roster was no longer on the website Thursday.

Bodison was listed as No. 31, a freshman infielder and business major. Kiser was No. 26, a freshman pitcher and outfielder majoring in criminal justice.

IS THERE A VIDEO FLOATING AROUND OF THE TORTURE AND DEATH OF THIS CAT?

The report said the case came to light as a result of a CrimeStoppers tip to the Lancaster Police Department, which turned it over to the sheriff’s office.

The anonymous caller said they’d learned of the incident from a student who’d been upset by the incident.

In the message, the text of which was included in the incident report, the caller referred to the cat as a kitten and said it had been shot in the head
“approximately 15 times.”

The caller said a fourth player uploaded a video of the incident to Snapchat, in which several people could be heard laughing in the background and that he later showed it to members of the women’s soccer team.

The incident report said an animal control officer recovered the cat’s carcass, which had been buried in the woods near the house. He said an X-ray conducted as part of the investigation showed only two BBs in its body.

Barfield said investigators were unable to recover the video from the student’s phone.

“This was a senseless and unfortunate event,” said Sheriff Barry Faile. “I hope these young men learn something from the negative consequences that have and will result from this incident.”

Bodison and Kiser are charged Thursday morning with ill treatment of an animal.

Anyone with additional information is asked to call the Lancaster County Sheriff’s Office at 803-283-3388 or Crime Stoppers at 888-274-6372.

According to pet-abuse.com, animal abusers are five times more
likely to commit violent crimes than non-abusers and violent
childhood and adolescent offenders against animals are likely to
repeat the criminal behavior as they become adults. Studies have
shown that most serial killers tortured animals as children.

New York: Tammy Green, 45, sentenced to prison for arson fire that killed her sister's pets

NEW YORK -- A 45-year-old woman was sentenced in Rensselaer County Court Friday to state prison on arson and animal cruelty charges, District Attorney Joel Abelove's office said.

Tammy Green of Castleton was sentenced by Judge Andrew Ceresia to two years and four months to seven years in prison.

Green pleaded guilty Aug. 17 to third-degree arson, a felony, and cruelty to animals, a misdemeanor, for a Feb. 2016 incident in which she set fire to her sister's house.

The sister's dog and three cats died in the fire, according to the release. Two firefighters were injured.

“This defendant caused tremendous damage and endangered others,” said District Attorney Joel Abelove in a news release. “Her callous and wanton actions took the lives of three innocent animals and injured two first responders. Thankfully, no one else was killed.”

Although it appears she's being sent to prison for killing the animals, she's really being sent away for the arson. She most likely would've been given probation if it were just the animals having been killed.
