The agency formally charged Homer residents Brian Hollenbeck, 36, and Brandi Hollenbeck, 29, of “overdriving, torturing, and injuring animals; failure to provide proper sustenance.”
The crime is a class A misdemeanor in violation of Agriculture and Markets Law of the State of New York, according to the agency.
“Champ,” a Rottweiler / German Shepherd mix who the SPCA estimates to be 2 years old, was found in an emaciated condition and with a severe leg injury.
They were released on their own recognizance and are scheduled to return to Town of Homer Court on March 19.
The SPCA says the owners let the dog out and it was loose for multiple weeks. When they found the dog, it was under someone's porch and malnourished.
Investigators determined that Champ was shot in the leg, but authorities are not sure at this time who shot the dog.
The SPCA says the couple did not make a sufficient effort to find the dog.
Initially, the SPCA indicated that the dog's leg would need to be amputated. Since then, they say the dog has improved. On Friday, the SPCA said they weren't sure whether the leg would need to be amputated.
Champ is being cared for by Country Acres Animal Service.
