Officer Brian Davis, 34, and his wife, Jennifer Davis, 33, have both been charged with cruelty to animals and inadequate care of animals. All the charges are misdemeanors.
Davis was assigned to the K-9 Unit at the Portsmouth Police Department. He is now in an administrative assignment.
The charges stem from a former Portsmouth Police horse’s death. The horse, named "Amy" was a 14-year veteran of Portsmouth Police’s mounted patrol before her retirement in 2009, when the Davis family adopted her and took her to their Suffolk home.
In March of 2013, Debra and David Kelly took over care of Amy, telling WAVY News’ Anne McNamara they wanted to save her life because she appeared emaciated.
A veterinarian who examined Amy said she lacked enough muscle mass or energy to stand and her condition was the result of “long term starvation in the hands of the previous owner.”
The decision was made during the last visit to euthanize Amy. She died two weeks after the Kellys took her in.
Debra Kelly worked as the police stable manager for nearly a decade, but she resigned this year after Amy's death.
"I am just really glad after all these years of poor Amy giving her life to the Portsmouth police department, and her dying the way that she did, that someone is finally going to be held accountable," said David Kelly.
No one came to the Davis' door when WAVY.com stopped by Tuesday. They will have their day in court.
David Kelly says he will go to court to see the case through, even though no ruling can bring Amy back.
"She didn't deserve it," he said. "So t's really good that something is finally going to happen."
