Works out to be about 1 day for each [original] count of cruelty. Does that seem fair? Did each animal only suffer one day?
FLORIDA -- A Barrineau Park man convicted of animal cruelty after more than 40 dogs were found in pens on his property will face jail time.
Last week, Circuit Judge Terry Terrell sentenced Roger Kervin, 67, to 90 days in Escambia County Jail, with credit for 36 days already served.
Terrell also ordered Kervin to serve two years community control, followed by three years probation, according to court records.
A jury convicted Kervin in May of two felony counts of animal cruelty and one misdemeanor count. Kervin had pleaded no contest to one misdemeanor count of unlawful confinement of an animal.
The charges stem from Feb. 14, 2012, when Escambia County Animal Control officers responded to Kervin’s home in reference to reports of a dog bite.
They found more than 40 dogs in pens on the property, along with several goats and hogs.
According to investigators, many of the dogs were malnourished, and showed signs of untreated illness and injuries.
One dog had multiple bite wounds and was extremely anemic, according to the testimony of an expert witness during the trial. Another dog suffered from convulsions, and yet another suffered from a severe skin infection, causing it to emit a strong odor.
Kervin said he could not afford to take the dogs to the veterinarian every time they were sick because of his fixed income. Instead, he said he usually tried to address the animals’ medical needs himself.
Kervin was ordered to serve of his jail time within the first two years of his supervision.
