Dallas Taylor Downs, 20, was arrested on an animal cruelty charge stemming from the August incident.
According to the probable cause affidavit, Downs' girlfriend said she woke up to the sound of her 8-month-old pit bull puppy named Tyson crying.
Kimberly Mollica, the girlfriend’s mother, told police she saw Downs drag Tyson out of his cage and take it outside about 4:30am. Mollica said she heard the puppy crying before it ran back into the house and back inside its cage.
Downs, who is 6-foot-5, 200 pounds, came back into the house and dragged Tyson out of the cage again, allegedly throwing it twice against the wall.
The pit bull pup then bit Downs on his right index and middle finger.
Mollica told police that Downs had been “abusive” with Tyson in the past.
The dog was taken to a veterinarian who diagnosed it with a fractured femur “consistent with a high-impact trauma” and a “trauma bruise” around the muzzle area.
Downs and his girlfriend, Nicole, had different versions of what happened to the dog.
Nicole told police that Downs was “playing rough” with Tyson, causing the dog to bite her boyfriend’s hand. That caused Downs, Nicole said, to punch and slap the dog. Nicole told police she was “not sure” if she saw Downs slam the puppy on the ground.
Downs told police that he was cleaning the dog’s cage at the request of his girlfriend when Tyson bit him, causing the man to drop the pit bull on the ground. Downs said he believes the dog fell on its back.
According to police, Downs’ version “is not consistent with the dog’s injuries.”
Downs is accused of animal cruelty and was released from the Palm Beach County Jail on Saturday in lieu of $3,000 bail.
