Hutchinson Police Detective Curtis Black said officers responded to a reported disturbance shortly after 12 a.m. Saturday at the home of Bradlee Ellis and Emileigh Martens in the 1500 block of West 24th Avenue.
Black said the disturbance, reported by a friend of the two, was believed to be domestic in nature, but when officers arrived they found the dead kitten in the home.
Black said Martens, 20, and Ellis, 24, were upset that the kitten kept "using the restroom inside" and Martens threw the kitten against the wall.
He said the two took turns tossing the kitten into walls and doors and at one point the animal injured its head.
The animal's body was taken from the home for a necropsy to be performed. Animal Control Officer Debra Kramer said a veterinarian determined the young kitten to be a domestic short-hair, yellow tabby male.
Both Martens and Ellis were booked into the Reno County jail, but released later on bond. Martens' bond was set at $250 and Ellis' was $750.
According to Kansas statute, an animal cruelty conviction carries a sentence of 30 days to one year of imprisonment and a $500 to $5,000 fine when it involves the person intentionally and maliciously killing or torturing the animal.
