Family dog allegedly shot, killed by Port Chester officer

NEW YORK -- A family is accusing the Port Chester Police Department of using excessive force after their golden labrador was allegedly shot and killed by an officer responding to a call of an unleashed dog in the neighborhood.

The incident occurred on Prospect Street on Thursday afternoon.

Justo Cabrera, the dog’s owner, was not home at the time of the alleged shooting. He says he was told that a woman in the neighborhood called police after his two dogs chased her while she was pushing a baby's stroller.

Obviously the dog was just a puppy in this photo

Cabrera admits that he has received two previous citations for not controlling his pets. He says the most recent incident happened two months ago and was dismissed in court.

[Why was it dismissed? Because the witness didn't show up? Because the owner promised the judge the dog wouldn't run loose any more? Tell us WHY it was dismissed. Officers don't normally write tickets that aren't valid.]

Cabrera and neighbors say that 1-year-old Marley was not an aggressive dog.

Police have not yet released details about the incident.

  1. I agree too many incidents and too many excuses about that dog. He wasn't even home how does he know what happened ????

  2. I live in the same state, nearby county. Most likely the citation was dismissed on a technicality -- such as the date not being clearly written -- I live in an apartment building, and if the super does not put out recycling correctly or such, sanitation gives a ticket to the building (ie landlord) and they usually fight it on that sort of issue. Considering the dogs got out 2 months ago, one would think that the owner would be more careful considering traffic and other issues of safety. Do these owners really care that little about their own dogs?
