Rich and Kristina Daniels say their 4-year-old corgi, Sam, was playing in their fenced-in backyard Tuesday evening when it was attacked by their neighbor's pit bull.
They heard their dog screeching and ran to the backyard. Somehow the pit bull got past the 4-foot fence and began mauling the corgi. The two were able to get separated and the corgi was rushed to the vet but did not survive.
After Sam died, the Daniels felt they had no choice but to call Lincoln Park police and animal control. They say they were stunned at the response.
"We were basically told it's a three strike rule, that as long as the dog doesn't attack a person the dog is given three strikes before the city comes out and forcibly takes the dog," Rich says.
FOX 2's Taryn Asher looked into the law. She was told the pit bull owner did receive a violation, but the dog in question must have a history for it to be taken away. In this case, that particular pit bull had no prior incidents.
The only recourse the Daniels have is to take their neighbors to court. The Daniels tell Asher they don't know what they're going to do.
In the meantime, their neighbors, who have a total of three pit bulls, told them they took the dogs somewhere else for a few days but they will eventually return to the home.
