Brevard man, Joshua Lee Werbicki, accused of sex with dog back in jail on sex assault charge

FLORIDA -- A man who was spared conviction on accusations he had sex with a dog is now accused of sexually battering a 21-year-old friend after she fell asleep.

According to Palm Bay police records, a friend of Joshua Werbicki, 22, arranged on Saturday to meet him at a hotel room where he was staying to have drinks and spend time together. Police say she got drunk and fell asleep on a bed.

Then, records say, Werbicki undressed and sexually battered her.

In a phone call monitored by police, Werbicki admitted to battering her, saying there was "no waking you up," records show.

He was arrested Tuesday. After police read him his rights, records show he told them he was aware she was sleeping and she didn't give consent. He was booked into the Brevard County Jail on two charges of sexual battery.

Werbicki was arrested in January after a Palm Bay woman, who suspected Werbicki was abusing a child, set up a surveillance camera in the home they shared to monitor him. Palm Bay Police Spokeswoman Yvonne Martinez said Werbicki was caught on camera having sex with an adult female German shepherd named "Angel."

Werbicki was booked on charges of cruelty to animals and sexual acts involving animals.

In April, he pleaded guilty and Judge Charles G. Crawford withheld adjudication, meaning Werbicki wasn't a convicted felon. He was sentenced to five years of probation, with conditions including he couldn't have contact with dogs or other animals he could engage in sexual contact with.
