NEW JERSEY -- All criminal charges were dropped against a city man accused of not providing necessary care to two Italian Mastiffs (aka Cane Corso) as part of a plea agreement reached in court Wednesday.
As part of the deal, Daniel Moore, 46, of Asbury Park, pleaded guilty to one civil animal cruelty charge for failure to provide care and will be required to pay $2,500 in restitution, have the female dog spayed and allow the Monmouth County SPCA to check in on the animals for three years.
“I’m going to get my dogs back,” Moore said. “I was falsely accused of animal cruelty and neglect and I’m going to clear my name up and resume my life.”
In July, Moore was charged with two counts of animal cruelty and one count of interfering with an officer after the MCSPCA responded to a complaint at his city home, SPCA Detective Sgt. William Hyer said in court. There was no water for the dogs and they were in need of veterinary care, he said.
Moore visited the dogs at the animal shelter and they are doing well, according to his attorney Mark A. Steinberg.
“The dogs are in good health now,” Steinberg said.
MCSPCA Chief Law Enforcement Officer Victor “Buddy” Amato said that Moore needed to be educated on how to care for his dog.
“Unfortunately some people we have to bring them into court for education purposes and this is a prime example, that sometimes it is about education,” Amato said.
A bigger bunch of bs I've never heard. The owner couldn't tell by looking at these dogs that SOMETHING WAS WRONG?! That they needed to be seen by a vet? He is a liar. The dogs being returned to him should NEVER have even been on the table for discussion as part of the plea deal.
In addition to Hyer, MCSPCA Lt. Veronica Ehrenspeck investigated the case, while Deann Bowen, who is on the SPCA’s medical staff, evaluated the dogs at the scene.
