Anniston bar owner, woman, arrested in animal cruelty case, police say

ALABAMA -- Anniston police have arrested the owner of a Noble Street bar and a woman in a case of animal cruelty.

Capt. Allen George said the incident happened Thursday at Damn Yankee's Oyster Bar, 919 Noble St.

Witnesses told police they saw a person on the building's second-story balcony repeatedly strike a dog with a piece of garden hose. The dog, yelping in pain, either leapt or fell from the balcony, landing in an alleyway below, they said.

The dog was seen bleeding from the mouth and was picked up by the same person seen striking the dog, George said.



George said during the investigation, David Martin Mogil, 49, Anniston, the owner of Damn Yankee's, and Mary Allison Barrett, 30, of Anniston, and the dog's apparent owner, would not tell officers where the dog was taken after the incident.

After the case was presented to the Calhoun County District Attorney's Office today, a warrant was issued for Mogil for aggravated cruelty to animals.

A search warrant at the apartment over the bar was also issued in an attempt to find the dog. Barrett was also arrested for second degree hindering prosecution.

Both Mogil and Barrett are being held without bond.

George said officers were told of a possible location for the dog at an out-of-town veterinary clinic. The investigation will continue. There is no information on the dog's condition.
