First hearing held in Grants Pass dog attack case

OREGON -- A Josephine County woman says her beloved pet did not kill her neighbor's dog.

Kary Miller appeared before a judge in the Josephine County Courthouse, Tuesday.

Miller is being charged with several code violations including having her dog attack another dog.

Miller's neighbors, Mike and Shelly Molea, say their 5 year old Dachshund, Ginger was brutally killed in their yard on October 27th by Miller's dog.

Shelly Molea says she was also bitten by the dog but because the skin was not broken, animal control did not take the dog away.

Now they want someone to take responsibility for Ginger.

"We can't put this behind us, until that dog is taken away.  We can't, we can't get another dog. And we don't want to be attacked by that dog on our property," Mike Molea said.

NBC5 tried multiple times to speak with Kary Miller on camera, she declined.

On Tuesday, she did say off camera that her dog did not attack the Molea's pet, though she said as a pet owner she is sorry for their loss.

The Molea's veterinarian said Ginger died of seven puncture wounds or dog bites.

The next hearing date has yet to be scheduled.
