NEW YORK -- A Brooklyn judge knocked down animal cruelty charges Thursday against a young man caught on camera kicking a harmless grey cat high into the air – saying there was no evidence the cat was actually hurt.
“It could be that the cat was injured. It could be that the cat was fine. We don’t know,” said Brooklyn judge ShawnDya Simpson, who let prosecutors charge him with a lesser court of animal cruelty.
“There are no allegations that the animal was examined for injuries or that there was any significant pain from the defendant’s actions,” Simpson wrote in her decision dismissing charges that could have put Andre Robinson, 21, in jail for up to a year.
Hmm, how about ShawnDya lets this POS kick her hard enough to make her go flying across the room and tell us whether or not she felt any pain or if she "was fine".
“The degree to which the animal is said to have traveled also does not establish sufficiently that alone that the cat suffered significant pain or was injured.”
The video of Robinson kicking the cat was posted to YouTube, where it quickly went viral.
Simpson allowed prosecutors to recharge Robinson with a lesser charge, which could land him behind bars for up to 90 days.
The half-dozen animal activists who have attended each of Robinson’s court appearances since his May arrest in Bedford-Stuyvesant were unhappy with the weakened charges.
“Who will speak for the cat? How will the cat defend itself?” asked Maria Clara, 56, who drove an hour from her home in Connecticut to attend court Thursday.
“We are disappointed but we are not going to stop coming.”
Robinson will go on trial January 20 on the new charges. He wasn’t present in court Thursday.
