But in December, a state appeals court overturned that verdict. A three-judge panel of the Fourth District Court of Appeal ordered Cornelio to be resentenced on the remaining felony counts for which she was convicted: two counts of owning an animal that killed a human.
The judges found the ownership charge was more specific and appropriate for her actions.
Vista Superior Court Judge Richard Whitney issued the new sentence.
Cornelio had already served the longer sentence; with good custody credits she was released from county jail on Feb. 7. With the slightly shorter sentence, the judge applied the extra time she had spent in jail as credits to cover any outstanding fines.
“The court considers you to have served your debt,” Whitney said.
Cornelio and her mother, Alba Cornelio, were convicted in the death of next-door neighbor Emako Mendoza, who suffered more than 50 dog bites on June 18, 2011, when their dogs squeezed through a hole in the fence and attacked the diminutive 75-year-old in her Paradise Hills backyard.
Mendoza ultimately had both legs and arms amputated. She died from complications on Christmas Eve.
During the trial, Deputy District Attorney Makenzie Harvey argued that the Cornelios knew their dogs were dangerous and could get through the fence hole, and took insufficient action, covering it with sticks and boards.
Alba Cornelio, 41, was convicted of the same charges as her daughter. She died of natural causes a month after the trial.
