MASSACHUSETTS -- A Framingham man should be charged with larceny and not bestiality after authorities said he was caught performing a sex act on a dog Thursday, his lawyer argued on Friday.
Lawyer Christopher Post said in a motion seeking to postpone Paulo N. Silva's Framingham District Court arraignment that the allegations support a charge of larceny of the dog's sperm, not bestiality because the act was not for Silva's own sexual gratification. Judge Jennifer Stark denied the motion.
Ashland Police arrested Silva, 51, on Thursday at 7:17 p.m. after the pit bull's owner told police he came home to discover Silva "masturbating his dog," to collect the sperm in the man's garage, prosecutor Laura Montes said during Silva's arraignment.
Silva is a contractor who did some work on the dog's owner's West Union Street home last year. Silva grew attached to the purebred pit bull, and would stop at the home periodically to play with the dog.
He also repeatedly asked the dog's owner if he would be willing to breed his dog with a friend's female pit bull. The owner said no, Montes said.
On Thursday, Silva told the dog's owner that the female dog was in heat and again asked if they could breed the dogs. The owner again said no, and also denied Silva's request to come to the house to play with the pit bull because the owner was not going to be home.
When the owner arrived home, he found Silva, of 47 Pratt St., in the garage, manipulating his dog's penis, Montes said.
When questioned by police, Silva admitted he wanted the pitbull to breed with his friend's dog, but said he was just playing with the dog and was not touching it inappropriately, according to an Ashland Police report filed in Framingham District Court on Friday.
Police charged Silva with bestiality and breaking and entering.
Montes asked Stark to hold Silva on $1,000 bail. Stark released Silva without bail, but ordered Silva to have no contact with the dog or its owner.
Silva is due back in court on June 1 for a pretrial conference.
