TEXAS -- Three pit bull dogs that were allegedly involved in an attack on a Cherokee Shores man in January have been ruled dangerous by a Henderson County Court Judge.
County Court at Law No. 1 Judge Scott Williams ruled on Wednesday that all three of the animals were involved in the attack, and ordered them humanely destroyed.
The ruling came at the close of a 2-day hearing.
In January, Precinct 2 Justice of the Peace Kevin Pollock ordered two of the dogs, owned by David Hayes of Arrowhead Drive in Cherokee Shores, euthanized.
Hayes appealed the verdict on Jan. 30, claiming there was no evidence that the dogs in question had caused Mikel Christopher Kirkpatrick's injuries.
After the appeal was filed, County Attorney Clint Davis decided to ask Williams to destroy all three dogs.
According to Henderson County Sheriff's Office reports, Animal Control Officer John Haverly seized the dogs after Kirkpatrick of Payne Springs was hospitalized for injuries he allegedly suffered during a pit bull attack.
HCSO reports said the incident occurred in the early morning hours of Jan. 19.
A resident in the Cherokee Shores subdivision called dispatch after 5 a.m. saying Kirkpatrick was in the ditch covered with blood.
The caller said she heard a dog barking and someone screaming. HCSO deputies arrived at the location, and took an animal-bite report.
EMS responded to the scene, and found Kirkpatrick had bite marks and lacerations on both his upper body and extremities.
Kirkpatrick was transported to East Texas Medical Center in Gun Barrel City for treatment.
He was admitted into the hospital, and placed in the intensive care unit.
