Two men charged with animal cruelty after leaving pup in stifling truck

MASSACHUSETTS -- Two off Cape men were charged with animal cruelty Monday following a night of drinking in Hyannis.

According a Barnstable police release, officers were first dispatched to Tap City Grill at 586 Main Street around 12:30 a.m. where two intoxicated men were refusing to leave.

Officers Nelson Souve and James Melia spoke with 29-year-old Justin Wagner of Fall River and 27-year-old Matthew Bernier of Westport, who opted to take a cab to Falmouth for the evening.

 

Forty minutes later the officers were dispatched to the Duck Inn Pub at 447 Main Street for the report of a stolen vehicle. Officers arrived to find Wagner and Bernier--both claiming their pickup truck had been stolen.

According to the release, Bernier became belligerent and uncooperative and was taken into protective custody. The pickup hadn't been stolen, police said, both men were just too intoxicated to remember where they had parked it. The officers also discovered that a puppy may have been left in the pickup since the men started drinking around 5 p.m. The temperature in Hyannis Monday had been over 80 all day.

Additional units were called in to search for the truck, which was eventually located around 3 a.m.

Inside, police found a German Shepard puppy in distress. The dog was frightened and panting when removed from its makeshift kennel (a box and blue tarp) in the pickup's cab. None of the windows had been left open, police said.


The puppy, which officers dubbed "Midnight" was given water and taken to the Barnstable Police Station where she was cared for until morning.

Wagner and Bernier were also taken to the station, but in handcuffs. Both were booked and charged with felony animal cruelty. Both were arraigned in Barnstable District Court on Monday, police said.
