Judge declares Bronxville dog dangerous

The encounter left the boxer with multiple bite wounds around its neck and a $1,100 veterinary bill.

NEW YORK -- A judge has declared a golden retriever a dangerous dog for an attack on a boxer in the Bronxville Dog Park.

Eastchester town Judge Janet M. Calano ordered that the three-year-old golden retriever owned by Dori Mathe, of Bronxville, be muzzled and leashed whenever he is out in public, evaluated by an animal behaviorist and have a $100,000 liability insurance policy, among other requirements. The order stems from a July 2 attack by Mathe's dog on an 11-year-old boxer owned by Rich Sauerhaft, of Mount Vernon.

The encounter left the boxer with multiple bite wounds around its neck and a $1,100 veterinary bill. Mathe claimed the boxer left a deep bite gash on her lower left forearm that required a series of rabies shots.

Sauerhaft filed a court case July 9 against Mathe under the state’s Dangerous Dog Law. Then Mathe's attorney, Lawrence Donovan, filed a dangerous dog case against Sauerhaft.

On Tuesday, Sauerhaft said winning the case didn't recover his veterinary expenses or court costs, which he described at "well into five figures." Sauerhaft also regretted taking the case to court.

"This was a really long, drawn-out, expensive and pointless process," said Sauerhaft, whose dog has recovered from the attack.

Mathe did not respond to email and phone requests for comment.

In her Nov. 13 decision, Calano noted that "there was no claim or proper proof submitted for reimbursement of any medical or veterinary expenses by either of the parties."
