Missouri: William Rabourn III, who threw tiny dog to death from window, avoids prison sentence AND has chance to have it wiped off his record as if he had never done this.

MISSOURI -- A man who admitted he threw a woman's dog to its death from a third floor apartment window received five years of probation on Friday.  A Greene County judge suspended a possible prison sentence for William Rabourn III.

Rabourn, 25, pleaded guilty last October for breaking into the apartment of a woman whom he had dated, and throwing her dog 47 feet to the sidewalk from a third story hallway window in June 2014.


He was mad because she had recently rejected his sexual advances on a bus trip, according to a Springfield Police detective’s probable cause statement against Rabourn. The throw killed the woman's Maltese-poodle mix.

Rabourn already paid restitution to the victim, Gabriel Ervie, and he’ll have to do 40 hours of community service while he’s on probation, as well as avoid alcohol and illegal drugs, and complete an anger management course.


Because the judge ordered a suspended imposition of sentence, if Rabourn successfully completes probation, his conviction will not show on his permanent public record.

Basically as long as he doesn't get arrested in the next five years this will be erased from his record AS THOUGH IT HAD NEVER HAPPENED. IT WILL NOT APPEAR ON HIS CRIMINAL RECORD SO ANYONE DOING A BACKGROUND CHECK WILL NEVER KNOW WHAT THIS MONSTER DID.

Here’s the details on Rabourn’s sentence, as provided by a clerk for Greene County Circuit Judge Calvin Holden:

Rabourn was placed on a five-year term of probation with a suspended imposition of sentence. Should he violate the terms of probation, the range of punishment for second-degree burglary is one day to one year in the Greene County Jail, two to seven years in the Missouri Department of Corrections and/or a fine up to $5,000. The counts can be run concurrent or consecutive to each other.


His conditions of probation are:
1. The defendant is to complete any drug or alcohol treatment recommended by Probation and Parole.
2. The defendant should not consume or possess alcohol nor be present in any establishment where alcohol is the primary item for sale.
3. The defendant should not use any hemp oil or hemp derivatives or any mood altering drugs such as K2, unless prescribed by a doctor and shall not adulterate or attempt to adulterate any samples submitted for drug or alcohol testing purposes.
4. The defendant should submit to random breathalyzers, urinalyses, or blood test to determine the presence of drugs and/or alcohol immediately upon the request of any law enforcement officer.
5. The defendant should have no contact with the victim in this case.
6. The defendant should pay restitution to the victim. (It should be noted restitution is already paid.)
7. It is recommended the Court order the suspension of subject's ability to earn compliance credit until restitution is paid in full, per RSMo 559.105.
8. The defendant should complete 40 community service hours through CASP within 1 year.
9. The defendant should complete an anger management program as directed by his probation officer.
10. The defendant should complete the Pathway to Change program through Probation and Parole.
11. The defendant is placed in TC2. (Intensive Supervision Court)
12. Court costs and $46.00 Judgment for Crime Victim's Compensation Fund.
