New York: Amy Person and Scott Moxham charged after animals found living in deplorable conditions

NEW YORK -- The Montgomery County Sheriff’s Office have found temporary homes for eight horses and three cows. The animals were being kept in unsafe and deplorable conditions and needed to be relocated quickly.

Police say on April 17 The Montgomery County Sheriff’s Office was dispatched to an animal complaint on Green Rd. in Sprakers. When they got there, deputies discovered eight horses and three cows living in unsafe and deplorable conditions with no water or food readily available to them. Also, on the property were approximately 30 pigs in three separate pens.

Deputies located five goats living in a camper which had no way to get out of the camper to escape the heat. They also did not have any water or food inside the camper.


Located outside of the pens was a pig that appeared to have a broken leg and was unable to walk. The pig did not have access to water or food.

Deputies located two deceased pigs hanging in the tree that the owner states that he was going to butcher.

A dead horse was found on the property that the owner said he put down for health reasons.

As deputies were checking the property the owners, Amy Person and Scott Moxham arrived on scene.

MidVale Veterinary Clinic was called to assist with health evaluation of the animals and to go over the living conditions. The vet advised that other than the pig with the broken leg all the animals seemed to be healthy. However the horses and cows could not live like that and needed to be removed.


Although the conditions for the other animals were not the best, they were sufficient. Scott L. Moxham and Amy C. Person were charged with 17 counts of the Agriculture and Markets Law 353 Failure to provide proper sustenance. Both subjects were processed and released on an appearance ticket to court.

The Montgomery County Sheriff’s Office was assisted by the New York State Police and Midvale Veterinary Clinic. The Montgomery County Sheriff’s would like to thank the public for their overwhelming responses to request them for help.
