"He was angry, vicious, dangerous animal. There is no two ways about it," said Eva Dwyer about a pit bull that she says killed her 10-year-old Pomeranian named Teddy.
She says it happened on Sunday while she was walking her dogs at Woodgate Park in Yorba Linda. She says everything happened when a small neighborhood dog got loose.
"I said, 'Excuse me, your dog is out, and he's not on a leash. Can you get your dog?' And he just stood there smiling. ... The next thing I knew, the man reached over that wall and I heard a gate ... and out shot a big, huge black and white pit bull that just shot toward the dogs," Dwyer said.
Dwyer says the man intentionally opened the gate and allowed the pit bull to attack Teddy. She says if it wasn't for two good Samaritans who heard her screams, she would have been attacked as well.
When deputies arrived, Dwyer says the situation took an unexpected turn.
"Nothing was done. The only report we got was a report through animal control, which we haven't seen," she said.
The Orange County Sheriff's Department investigated and said they could not prove intent, so they could not make any arrests.
Why isn't the victim's word good enough to charge the pit bull owner? Let them go to court and testify and let the judge decide who's telling the truth. That's better than doing NOTHING - which is what you're doing, Orange County Sheriff's Department.
Animal Care services picked up the pit bull and will keep the dog until the investigation is over.
We tried talking to the pit bull's owners to get their side of the story, but the person who answered the door said they have no comment and slammed the door.
