The incident is alleged to have taken place around Dec. 4, 2012, according to a probable-cause affidavit filed in Allen Superior Court. Larry D. Knox, according to the affidavit, contacted the Fort Wayne Police Department and notified them that a stray cat was inside his home.
Knox reportedly told responding officers that a cat had entered while he was moving an appliance and that he discovered it later.
The officers, as well as an officer from Animal Care and Control, were invited inside the home to retrieve the cat, which they found behind a mattress and set of box springs. The cat appeared to be "dazed or stunned, with its eyes going back and forth and (its) head was moving around," the affidavit said.
When asked about the condition of the cat, Knox reportedly told the officers that the cat should be stunned because he kicked it "hard."
The affidavit claims that Knox laughed as he told the officers that after finding the cat in his living room and that it didn’t leave when he opened the front door, he kicked the cat in its face and that one of the feline’s top teeth fell out.
Knox reportedly told the officers that the cat ran into a bedroom and that he followed it, kicking it a few more times, according to the affidavit.
Knox reportedly told the officers that he did not feel threatened by the cat but that it was not his and that he did not like cats.
The officer from Animal Care and Control took the cat into its custody, where it was taken for medical treatment and examination. Knox, according to the release, came to the Animal Care and Control shelter to be interviewed but declined to waive his rights.
He is charged with Class D felony cruelty to an animal; torturing or mutilating a vertebrate animal.
