Civil lawsuit filed in police killing of Commerce City dog

COLORADO -- A civil lawsuit was filed Thursday against the City of Commerce City and several officers over the death of a dog shot and killed in November 2012.


The Animal Law Center filed the lawsuit on behalf of their client, Gary Branson, the owner of the slain dog named Chole. "It's very important that we pursue justice for Chloe and Gary," said Jennifer Edwards, attorney and founder of The Animal Law Center said in a statement.



"Last month's not guilty verdict for Officer Price on animal cruelty charges was a shock, especially given that video evidence of the incident shows Chloe trying to flee and not acting aggressively toward officers. We have to correct this travesty." The lawsuit also states that Chole was Branson's therapy dog.

On Nov. 24 2012, three Commerce City Police officers responded to reports of a "loose, vicious dog." During the encounter, Officer Robert Price - a 6-year veteran of the force - shot and killed the dog.



Price was among several officers who responded to a call about a dog running at large in the 9600 block of Nucla Street in Commerce City. The dog was shocked with a stun gun and then shot multiple times. A neighbor took cellphone video of the dog's death, which was a key piece of evidence in the case. Price was found not guilty of animal cruelty in October 2013.

The dog's owner, Gary Branson, said the verdict was "not justice for Chloe." The Commerce City Police Department said Price will return to duty.

He was on paid administrative leave since the incident. The Fraternal Order of Police said Price was wrongly accused, and supported Price throughout the trial.
