Texas: Animal cruelty charges brought against Tomball optometrist Elaine Kmiec

TEXAS -- A Tomball optometrist who had more than 100 collies seized from her property has been charged with four counts of misdemeanor animal cruelty.

Dr. Elaine Kmiec is scheduled to appear Tuesday in Harris County Court at Law No. 10.

Although Houston Collie Rescue removed dozens of dogs from her property on Aug. 29, charges were filed May 12 regarding just four animals that Kmiec failed to give necessary food, water, care or shelter: Corky, Penny, GiGi and Isaac.


According to court records, Corky was missing hair over about 60 percent of his body, and lab tests showed that he had demodectic mange, hookworms and coccidian.

 


Penny had hookworms, hair loss on her left hip that appeared to be a scalded or burnt area and thinning hair on her forehead, the criminal complaint stated.
GiGi and Isaac had dental and eye problems, records state.

"Many of the other animals were also in poor to severe conditions," the criminal complaint stated.

 

According to court records, 12 volunteers with Houston Collie Rescue were at Kmiec's home when the dogs were removed.

The group president, Vickey Willard, said the final count of dogs removed was 146, after five pregnant females gave birth.

 

As the result of a federal bankruptcy case filed earlier, Kmiec is prohibited from owning, keeping or caring for any animals that might come onto her property, except for strays she can't control, such as stray cats. However, she is not allowed to put out food, water and shelter for strays, according to the federal court order issued April 30.
