Facing more than five years in prison, Brian Scott Burlingame, 57, gets just 90 DAYS in jail after killing girlfriend's Yorkie

CALIFORNIA -- A Hawthorne man who threw a cupcake cooling rack at his girlfriend, killing her Yorkshire terrier in her arms, has been sentenced to 90 days in jail and to perform 90 hours of community service.

He was facing up to five years and eight months in state prison.

Brian Scott Burlingame, 57, also was placed on five years formal probation when Judge T.K. Herman sentenced him Tuesday in Torrance Superior Court.

Burlingame received basically what prosecutors offered him in an October plea deal, which he declined, putting his fate in the hands of the judge, hoping Herman would agree with his girlfriend’s testimony that he did not belong in jail.


Prosecutors said Burlingame was arguing with his girlfriend, Linda Castle, on June 14 at her El Camino Village home when he threw the rack. It hit her dog, Bodie, cutting his head. The dog died at a veterinary hospital.

Burlingame pleaded no contest in October to charges of animal cruelty and corporal injury to his girlfriend.

He is scheduled to surrender Dec. 29.
