James Duff, 53, said he was along the fence of his home near Georgetown when the Border collie named "King," who was in his own backyard, jumped up and bit him.
I don't know.. that doesn't really look like a Border Collie...
The incident happened in December 2014, and Duff and his guardians filed a civil lawsuit against owners Allen Smith and Patricia Briggs. The case went to trial this week, resulting in the jury's award.
The suit claims they should have known the dog was dangerous because it also bit a 12-year-old boy the prior year. At that time, according to the suit, animal control officers "counseled defendants on options to prevent King from jumping up to the top of the fence as well as the need for training for King."
According to court records, jurors found the couple negligent and awarded Duff $100,000 in medical expenses and $10,000 in punitive damages. A judge must approve the amount and issue an order.
Really, he's only getting $10,000 for his pain and suffering. The other $100k is for medical costs - the emergency room visit, follow-up doctor care, etc.
The attorney for Smith and Briggs declined to comment Friday.

Agreed, does NOT look like a border collie. Neither does the damage. The muzzle is way too broad. The bites way to severe. No shepherd in their right mind would breed a sheep herding dog capable of doing that to a sheep, let alone a human. Maybe a border collie crossed with 'something'.
ReplyDeleteagreed. crossed with "something".
ReplyDeletehmmm, looks like a cousin...

I would like to clarify part of this post if I could. I served on that jury, and the 100k was the award for pain and suffering. The 10k was the amount they were fined for criminal negligence.
