The gash was 4 inches deep, but Manness, the puppy's owner, allegedly refused to take the dog, named "Murphy," to the vet, prosecutor AnneMarie Gochis told a Lowell District Court judge on Tuesday.
Nearly a year later, Manness, 42, of Lowell, appeared in court in a suit and tie, and reported that he is currently in a residential treatment program.
To resolve the case, Manness admitted to sufficient facts to one count of animal cruelty for the Nov. 2, 2015, incident. Judge Daniel Crane continued the case without a finding for one year while Manness is on probation.
Crane added one condition to Manness' probation; he is not to have any animals or service dogs while on probation. If Manness has no further problems with the law, the case will be dismissed.
What they need to do is include that he is not allowed to drink alcohol and should have to submit to random breathalyzer tests to prove it - since he blames his abuse of the puppy on his drinking problem.
Police allege that they responded around 7 p.m. to do a wellness check on Manness after his sister called to report that her brother had been drinking throughout the day and refused to take the puppy to the vet for care of the serious wound (it was a 4-1/2 inch gash SO DEEP YOU COULD SEE INSIDE TO THE PUPPY'S SKULL).
When police arrived, they found the apartment in disarray with "feces all over the apartment, including in the dog's bed," police said.
Manness claimed the dog was injured when it ran into a wall.
Manness agreed to let his sister take the dog to the vet. The dog was still in the hospital several days later after the wound had to be drained three times before it could be stitched.
