MICHIGAN -- Our Macomb County dog bite lawyers recently filed a lawsuit on behalf of a four year old girl.
The girl was at a neighbor’s home playing with another child at the house. The family’s golden retriever attacked the young girl without provocation and bit her in the face.
The incident was investigated by the Macomb Sheriff Department and Macomb County Animal Control.
The dog bite the face caused a number of punctures wounds and lacerations on her face, head, and ear. She was taken to the hospital for emergency treatment and care. The bit caused permanent scars and disfigurements to her face.
The dog bite lawsuit was filed in the Macomb County Circuit Court in Mt. Clemens, Michigan. The case seeks compensation for the scars, disfigurement, fright and shock, and other non-economic damages. The suit also seeks payment of medical expenses to date and money for future plastic surgery to repair the scars when the girl becomes a teenager.
The lawsuit was brought by the parents of the girl. Under Michigan law, a person under the age of 18 years old cannot bring a lawsuit on their own. Rather, a parent files the lawsuit on behalf of the child. The case proceeds as all other cases but the parties cannot agree to a settlement without a judge approving of the settlement. This is the court system’s way of looking out for the best interests of the child. No date has been set for a jury trial in this matter.
