Hi. My dog Reeses is a Shorky (aka Shorkie, a Shih Tzu / Yorkie). He's my best friend and has been for 8 years.

Just this week he was attacked by a pit bull and gashed his stomach and broke his leg.

Just yesterday we received a call from the vet saying the tooth of the pit completely broke his leg in half and he had to get his leg amputated.

I would really love prayers for him because his injuries were bad and i cant lose my best friend. I pray he heals fast and learns to walk with only 3 legs..

the pit already killed my neighbor's poodle and now mine could possibly die. Please pray for him.. it hurts me to see him like this... (The pic shown is before we knew he had to get an amputation)

Note: In the comments he says the Pit Bull is owned by a police officer, who had promised to keep the killer dog up after it mauled to death the little Poodle. Clearly this guy has no concern for anyone but himself and his mauler. I hope they get the authorities involved to do something about this dog. 

Ohio: Edwart Hirt and Marijana Simiceric-Martin keep getting vicious pit bulls which then attack and kill pets and attack people

OHIO -- The owners of two pit bulls which viciously attacked, mauled and killed another dog and also injured its owner and another man while walking on Pellett Drive Aug. 20 were fined the maximum amount in a plea agreement which allowed them to see the dogs one more time before they were euthanized.

Edwart Hirt and Marijana Simiceric-Martin were ordered to pay $353 in fines and court costs after entering into the plea agreement in Rocky River Municipal Court last Thursday. The agreement required no contest pleas to dog at large charges and dropping their appeal of Bay Village Police Chief Mark Spaetzel’s recommendation the two pit bulls be euthanized.

then the other pit bull jumped on me."

Spaetzel based his recommendation on the two pit bulls’ continued aggressive behavior even after being taken into custody by the Cuyahoga County Animal Warden after an investigation of the Aug. 20 incident.

Gary Ebert, Bay Village’s interim mayor and law director, said the sentence was the best possible given the circumstances.

“It was the best possible under the old laws governing this type of incident,” he said.

Hirt and his attorney did not return calls for comment on the verdict or the incident.

Safety officials said the charges stem from an incident in which the two dogs ran out of a Pellett Drive home and attacked Thomas Moran and his dog, Charlotte, while they were walking. Charlotte died from injuries suffered in the attack. 

Moran and his son-in-law were both bitten while trying in vain to save Charlotte.

OWNERS HAVE HISTORY OF OWNING VICIOUS PIT BULLS

After the incident, angry citizens met with Bay Village officials twice and also attended Bay Village City Council meetings demanding action.

Many noted that in 2015 another pit bull had come out of the Pellet Drive home and attacked and severely injured another smaller dog. That pit bull was also confiscated by safety officials. 

In addition, when Bay Village officers were doing a child welfare check several weeks ago at the Pellett Drive home, they found another pit bull in the home, Spaetzel said.

Since then, Bay Village City Council has passed revisions to its animal control laws which toughen the penalties for animals which attack and either severely injure or kill a domestic animal or a person. The tougher penalties provide an escalating scale of fines and possible jail time for repeat offenses which can be imposed on the owner of the attacking dog.

“With the tougher laws, it’s easier for the city to deal with these types of offenses,” Ebert said. “And City Council and the administration are continuing to review the laws and take other steps to deal with these types of issues.”

Ebert said the city is also moving ahead with bringing back a part-time animal control officer for the city. He said job criteria for the position have been developed and Bay Village City Council will set aside money for the position in its budget. Bay Village’s last animal control officer position was cut several years ago as the city tried to cope with the economic effects of the Great Recession.

Ebert said interviewing for the new animal control position should begin shortly.

OHIO -- Two pit bulls have been confiscated by law enforcement officials and face euthanization, and angry residents are telling Bay Village officials they want existing laws strengthened after the two dogs attacked and killed a small dog while it’s owner tried to protect it during an Aug. 20 assault on Pellett Drive.

About 80 people attended a neighborhood meeting called by Ward 4 Councilman Tom Henderson Monday night at the Bay Lodge to discuss the situation.

The two pit bulls remain in the custody of the Cuyahoga County animal warden’s office, which investigated the incident along with the Bay Village police Department.

Charlotte, a Yorkie - Shih Tzu mix (aka Shorkie), succumbed to her devastating injuries while being rushed to a vet. 

Her owner and his son-in-law were attacked by the pit bulls while they and another man tried to protect Charlotte, police said.

Bay Village City Police Chief Mark Spaetzel said it is the second incident in little more than a year involving dogs owned by the same family on Pellett Drive.

In 2015, an eight-year-old Cocker Spaniel mix was attacked by a different pit bull – in that incident the smaller dog suffered major injuries but survived after multiple trips to vets. That pit bull was taken and sent to a shelter out of the area, officials said.

This is what's called NIMBY = not in my back yard. They exile the vicious dog out of their jurisdiction into another unsuspecting community so that this vicious dog can then attack and kill in their community.

Spaetzel said he is recommending the two pit bulls be euthanized, based on the attack and that the two dogs are continuing their aggressive behavior while in custody. He said it’s likely the county will accept his recommendation.

Spaetzel, Henderson and Bay Village Law Director Gary Ebert said under the current laws they can only charge the pit bulls’ owners with a minor misdemeanor, dog-at-large, meaning a fine in Rocky River Municipal Court.

"My little 16-month-old granddaughter walks around the house and asks for the dog. She is looking for it. And it tears me up when we see that," said Thomas Moran.

Residents told the officials people in the neighborhood are afraid to walk their dogs or have their children go by the home because the owners have had the pit bulls and other dangerous dogs there on a consistent basis the last several years. They asked why more action has not been taken. Several asked if it would take a small child being killed for council to take action. All the officials noted the city still has to follow existing laws and the pit bulls’ owners also have rights as citizens.

 

“I feel terrible for the residents who were attacked and for their dog, Charlotte, who was killed,” he said. “This is a heartbreaking event that has affected not just one family, but a whole neighborhood.”

Henderson said current laws focus on the dogs themselves.

“Perhaps we need to turn our attention to the owners of dangerous dogs, particularly if a person owns or has owned more than one dangerous dog in the past,” he said. “If we can enact an ordinance that will increase public safety without violating the rights of dog owners across the city, I will seek to advance such an ordinance.”

According to police chief Mark Spaetzel, the pit bulls are owned by Edward Hirt and Marijana Simiceric-Marlin (aka Marijana Simiceric-Martin). The two were charged with two misdemeanor counts of dogs running at large each. Hirt was also charged with not having an up-to-date rabies vaccination.

Meantime, the dogs are currently being held at the Cuyahoga County kennel.

"I notified the owners that we've petitioned the court to have both dogs euthanized. The reason is that both dogs pose a danger and there's a high likelihood it will happen again," said Chief Spaetzel.

But for some, it's not enough.

Resident after resident voiced their concern that a vicious and dangerous dog ordinance should be stricter within the city.

"It's upsetting just knowing that this isn't the kind of thing that should be happening on our street. In our city. This shouldn't be happening," said Gil Moran.

Chief Spaetzel adds that the maximum punishment for the misdemeanor charges is $150 dollar fine.

OHIO -- Hopefully, many of you are already aware of the dogs that attacked our family on Pellett Drive last Saturday evening.

My husband Tom, was standing on our lawn in front of our home. Two massive dog [pit bulls] from across the street charged and attached Tom as he held our 10 pound puppy, Charlotte.

He tried to ward them off but they knocked him to the ground. Our daughter and son-in-law, standing in the yard, attempted to pull the dogs off Tom as he lay on the grass. A passer by from the neighborhood also attempted to try to remove the dogs from biting my husband. Our 8 year old grandson watched as his family and pet were attacked.

Police and the EMS squad responded. Tom and my son-in-law were transported to St. John's by ambulance for treatment for their injuries. Our puppy Charlotte died from the attack.

We were informed yesterday by city officials that Marijana Martin and Ed Hirt, owners of the dogs, will be be charged with two misdemeanors as a result of the dog attack. They include a charge for their dogs not being on a leash and failure to update the dogs rabies shots. These will be the only charges brought against them.

The dogs were removed by the Bay Village Police Department and taken to the Cuyahoga County Kennel. We were told by city officials that there is a possibility that these dogs could be returned to their owners after 10 days.

Other dogs that Hirt's owned had escaped in the past approaching and antagonizing neighbors. Last year there was a similar attack to our neighbor and her dog as she walked down our street. This attack was by another dog owned by Mr Hirt. Although we and many others called city officials to voice our concerns to our councilman, law director, and police department the problem was not resolved. I now wish I had pursued the matter further. You never expect it to happen to your family.

Tom and I are very grateful for the show of support for our family from neighbors and the members of our community. We also hope you will consider attending the meeting with city officials that will take place on Monday evening at 7:30 at the Bay Lodge. We know that little can be done to help our family but hopefully we can make some changes for the benefit of all.

We had a similar occurrence in Avon Lake last year.Our neighbor was walking his pup and two pit bulls left their yard and attacked and killed the dog and injured our neighbor. The owners had a faulty gate, they escaped. The sad thing is that this wasn't the first instance with the pits. We went to the council meetings, voiced our opinions . The owners of the pits still have one of the dogs and the victim is still trying to get justice. Hopefully you will have a good turnout and justice will be served.

Jen Appleby: Seriously, what are you and/or your family doing to the dogs to make them so aggressive? That's pretty abnormal behavior, doesn't matter what breed it is. It seems like they're abused and being put in a bad environment to begin with - these dogs sound like they're trained to fight, and aggression does breed aggression. And the fact that this has happened a few times already with different dogs is a HUGE red flag. If you can't own a pet responsibly, and you've had more than one horrible incident occur because of it, you shouldn't be able to own pets. Period.

OHIO --  A fatal pit bull attack in Bay Village has an entire neighborhood on edge.

One year ago, an 8-year-old Cocker Spaniel mix was viciously attacked by a pit bull who ran out of a home on Pellet Drive in Bay Village.

This past Saturday, there was another attack by dogs that lived inside that same home. But this time, the victim would not survive.

"She looked at me and I knew it was done," says dog owner Thomas J. Moran.

He fought back tears as he talked about his beloved Yorkie-shih tzu mix Charlotte.

The two-year-old was attacked by the neighbor's dogs while in Moran’s arms.

Moran says, "I noticed the two pit bulls running straight out of the house across the street and they were making a straight dash towards me.

"It grabbed her lower half and was pulling down on the dog or just actually his weight pulling down as he grabbed Charlotte. It was pulling me down as well, and then the other pit bull jumped on me."

 

Although many people dispute that pit bulls can "lock" their jaws, what they do is clamp down and either crush the windpipe of the victim or do what they did here with Charlotte they latch on and pull and rip the victim to pieces.

Moran’s wife Gail added, "He had blood all over his shirt and the dog was bleeding profusely out of her back, the whole back of her body was ripped open."

 

 

Thomas suffered cuts and bruises to his arms and hands, but he, along with his son-in-law and a passing biker could not fight the pit bulls off in time to save little Charlotte.

Police say the pit bulls are owned by Marijana Simiceric-Marlin.

Her name has also been spelled Marijana Simiceric-Martin.

She did not answer the door for comment, but did speak to Bay Village police and animal control investigators who arrived on the scene as FOX 8 cameras were rolling.

 

The pit bulls involved in the attack were brought to the Bay Village police department by their owners immediately following the attack on Saturday. The dogs will now be turned over to the Cuyahoga County dog warden as the investigation continues.

Cuyahoga County dog warden Deborah Conway says, "A dog that bites and causes injury or kills another dog under the state law can be deemed dangerous. And anytime that a dog bites, it has to be quarantined for ten days for rabies."

As the Morans wait for the results of those rabies tests, they are thankful Thomas wasn’t seriously injured.

But they are still grieving the loss of a cherished family member.

"She was the only one here a lot of the times, so she was my sole companion."

Bay Village shut down its animal control offices four years ago, due to budget constraints.

Neighbors say although charges were brought against the owner of the pit bull who attacked the dog last year and the dog was removed from the home, if these [pit bull] breeders were closely monitored, last Saturday’s tragedy could have been prevented.

Criminal charges against the owner of this most recent case are pending.
