California: Two Chihuahua puppies found abandoned in trash can

CALIFORNIA -- County Animal Services is looking for information on the person who threw away two Chihuahua puppies in a trash can at the Old Town trolley station last week.

The dogs, estimated to be about seven weeks old, were discovered Friday and taken to the San Diego County animal shelter on Gaines Street.

Veterinary staff determined the dogs were females and appeared to be in good health.

County Animal Services asked a rescue group to foster the puppies due to their young age. When they are old enough, the group will put the puppies up for adoption.

Earlier this month, two 12-day-old puppies were found inside a box in a dumpster in the Midway area.

“There is no reason whatsoever to dump puppies, kittens or any other animals in a trash can where they are certain to die,” said County Animal Services Director Dan DeSousa.

“Anyone can drop off unwanted animals at County Animal Services where they’ll have an opportunity to find a good, loving home.”

Animal Services asks anyone with information on who owned the abandoned puppies or the identities of the people who committed the crimes to call 619-767-2740.

A suspect convicted of animal cruelty or abuse could face up to three years in prison, a fine of up to $20,000 or both.

Anyone who witnesses or suspects animal abuse or neglect is asked to call 619-236-2341.

UNITED KINGDOM -- Firefighters had to rescue a cat after it got its head stuck in a trash can.

The curious kitty was rummaging around before putting its head through a hole.

Solihull Fire tweeted the pictures of the cat, which was checked out and given a clean bill of health.

Kansas: Michael Kewley, who has a history of torturing and killing dogs, was given diversion after beating and killing his 10-week-old puppy in 2015. Police have found another dead dog, strangled to death with a leash, on his property

KANSAS -- When Michael Kewley surrendered himself to officers, police say they found several loose rounds of .45-caliber ammunition in his pocket.

Across the street, Kewley's neighbor found another bullet on his kitchen floor and several bullet holes in his home.

Lawrence police officers were familiar with Kewley, according to a recently released arrest affidavit. They were aware that he is a veteran who reportedly served time in special forces and suffers from post-traumatic stress disorder, night terrors and blackouts.

The affidavit — a document that explains the reasons for an arrest — offers new details in the case of an armed standoff between police and Kewley that lasted several hours on Lawrence's southwest side and resulted in a number of felony charges. Allegations in an affidavit still must be proved in a court of law.

Currently Kewley is being held in the Douglas County Jail on a $50,000 bond and is awaiting a hearing later this month.

Kewley served multiple deployments in Iraq and Afghanistan, said one person who asked not to be named but said she lived with him. The woman also said Kewley is under care of the U.S. Department of Veterans Affairs and recently experienced the deaths of two close friends, which caused him to become suicidal, the Journal-World previously reported.

And if officers weren't aware before, they were told on April 4 of Kewley's distrust of law enforcement, the affidavit says.

That morning, around 7:15 a.m. officers were dispatched to Kewley's home at 2525 Scottsdale St. to check on Kewley, who was reportedly threatening to commit suicide.

One woman who met Kewley on a dating website called police, the affidavit says. She told them she woke up that morning to a text message from Kewley that said "I'm sorry dear I'm gonna have to do something very dumb and regretful. And please leave poppy flowers at my grave at Arlington."

That same morning, an officer was sent to the home across the street from Kewley's, the affidavit said. There, one man said he awoke around 3:15 a.m. to the sound of a gunshot. Looking outside after hearing the noise, the man said he saw a motion sensor light was on at Kewley's home.

The man told police he was familiar with guns and "was certain he had a bullet hole in the front of his house," as well as "what he believed to be a pistol round on the floor of his kitchen," the affidavit says.

Considering the situation, officers contacted one of Kewley's ex-girlfriends, who arrived on the scene shortly thereafter, the affidavit says. The night before she told police she found Kewley drinking alcohol in his garage and called his probation officer.

Kewley was on probation from a 2015 criminal restraint conviction. That same year criminal threat, criminal restraint and cruelty to animals charges were filed against him after he beat and tortured a 10-week-old puppy to death. 
  
However, Kewley was granted diversion in the animal cruelty/torture case, meaning after a period of time, possibly a year, it was erased from his record as though he had never grabbed that little puppy and brutalized it until finally killing it.

Had they even ordered mental health counseling/treatment? Did they bother to ban him from being around animals? If the animal cruelty case was already dismissed off his record, that means they only gave him a year for torturing and beating this puppy to death. 

Around 9:15 a.m. the woman who originally called police, called again, saying she was on her way and told officers Kewley said he "would have a gun and knives on him 'for protection from the police,'" the affidavit says.

In addition she warned police the home's front door might be rigged with explosives. She described police as a "trigger" subject for Kewley because he "believes the police are against him."

Soon police spoke with Kewley over the phone and asked him to come outside, the affidavit says.

As police spoke with Kewley he left the home several times, wearing a ballistic vest and appearing to "assess the location and position of police personnel surrounding his residence," the affidavit says.

That day police said they were concerned Kewley was armed with a "long gun." Dozens of officers responded to the scene, some in their personal vehicles, some in marked cars.

Ultimately, no "long gun" was found in the home.

Several streets in the area were blocked off as more and more officers arrived on the scene. One area resident who lives nearby said she heard around seven gunshots fired the night before.

Officers patrolled the neighborhood with rifles and both Sunflower Elementary and Southwest Middle schools were placed on lockdown.

Officers told Kewley to raise his hands and walk toward them multiple times, but he would not, the affidavit says. At one point Kewley threw a propane tank out his front door, which officers believed was either an explosive device or something he might shoot to cause an explosion.

Later, Kewley removed his ballistic vest, though he was concealing a knife behind his back and challenging officers to come to him, the affidavit says.

Refusing to drop the knife, Kewley "retreated into the house and said, "I guess we'll just have a gun fight," the affidavit says.

Around 2:43 p.m., Kewley surrendered to officers and was arrested without further incident, the affidavit says.

Searching his home, officers found one handgun, a ballistic vest with a large kitchen knife inside a pouch and a number of magazines loaded with dozens of handgun and rifle rounds, the affidavit says.

Officers found one dog inside the home and a dead dog inside a recycling bin outside the garage with "a leash secured tightly around its neck."

One of Kewley's male roommates later told police the dead dog belonged to Kewley and that the dog had been alive the night before, the affidavit says. 

Why was he even allowed to be around animals??? This dog's torture and death is 100% the fault of the prosecutor's who failed to protect it. How many other animals - kittens, puppies, turtles, raccoons, birds - has he tortured and killed??

A second male roommate said Kewley fired a number of gunshots that night.

This spring, that second roommate told police, Kewley had started doing drugs, behaving aggressively and speaking about his time in the Army, the affidavit says.

He said he originally woke up to a single gunshot and asked Kewley, who was drinking whiskey, to "knock it off," the affidavit says. 

Kewley apologized and the second roommate went back to bed, only to wake up once more to the sounds of a dog "yelping real bad."

Again, that roommate said he approached Kewley, who spoke of killing one of his two dogs, the affidavit says. 

The second conversation took place around 2:30 a.m. and Kewley was reportedly acting paranoid at the time.

That roommate told police he stayed with Kewley, who fired his handgun a number of times throughout the rest of the morning, the affidavit says. Eventually, after one gunshot, the electricity in the garage, where they were, went out.

"(The roommate) assumed a bullet hit electrical wiring in the wall," the affidavit says.

When asked why he didn't call police, that roommate said when he left for work that morning Kewley was "passed out 'face down' on the kitchen table," and he "hoped Kewley would sleep it off, and be himself by the time he returned home from work," the affidavit says. He added that he planned on contacting police at some point because Kewley "needs help."

HISTORY OF TORTURING DOGS, SAYS ROOMMATE

Previously that roommate had told police he saw Kewley abusing dogs, the affidavit says. 

Once he reportedly strung a dog up by the neck over a cross bar and a second time he hung a dog by a heavy bag stand, according to the affidavit, though Kewley maintained he was "just training" the dogs.

Several days after the standoff, another neighborhood resident called police after finding a bullet hole in his home, the affidavit says.

Kewley is scheduled to appear in court on May 31 for a preliminary hearing, where he and his attorney, Adam Hall, will have a chance to respond to the allegations. During that hearing a judge will determine if enough evidence exists to order Kewley to stand trial.

Alongside charges stemming from the standoff, Kewley is accused of violating his probation, and his diversion agreement from his second case in 2015 has been revoked.

Pennsylvania: Garbage men rescue cat found doused in gasoline, tied up and sealed inside a trash bag

PENNSYLVANIA -- Authorities in a Pennsylvania town are investigating this week after garbage collectors found a cat that was tied up and doused with gasoline inside a trash truck.

On Wednesday, Humane Pennsylvania asked the public for help locating those responsible in the case of animal abuse. A $1,000 reward is available for information that leads to an arrest and conviction.

The incident occurred Tuesday in Reading, Berks County where rescue workers are calling the female cat, "Miracle Maisy."

The garbage was being compacted in the truck when collectors heard cries from inside the vehicle. The workers found the cat inside one of the trash bags. The animal was found tied up and doused with gasoline.

Miracle Maisy was immediately transported to the Humane Society of Berks County for an evaluation but was sent to Humane Veterinary Hospitals Reading for treatment.

Officials said Miracle Maisy is recovering from her injuries but medical expenses are mounting. Humane Pennsylvania is covering all costs but asks the public for donations to her medical fund.

The Reading Police Department is currently investigating the report of animal cruelty. Anyone with information is urged to call police at (610) 655-6116.

Illinois: Animal cruelty, marijuana suspect Deon Nailing back in county jail

ILLINOIS -- A man who awaits sentencing for beating a dog to death is now accused of planning to sell marijuana.

Deon D. Nailing is currently at-large after failing to return to jail after he was released for treatment of a medical condition, according to records in his case.

Nailing, 36, of Charleston was arrested on March 6 for reportedly having nearly 3 ounces of marijuana that was packaged for sale.

That was four days after he pleaded guilty to a charge of aggravated cruelty to animals for allegedly beating a pit bull to death on Feb. 1, 2016, in Lerna, where he lived at the time.

Deputies were first dispatched to Lerna on Feb. 1, when a woman said Nailing threatened to harm both her and the dog. Nailing was also questioned and claimed the dog caused the bruising the deputies saw on the woman, she said.

Deputies were called back to the scene the following day, when the woman claimed Nailing hit her and had killed the dog and buried it, Stephen also said. Investigators couldn't find any signs of a burial but later located the dog's body and the mallet in the trash bin, she said.

Records in the newly filed drug case say Nailing was released from jail on March 7 to go to Sarah Bush Lincoln Health Center for treatment of a medical condition.

He was then transferred to Carle Foundation Hospital in Urbana. On March 11, Carle notified Coles County authorities that he had been released, the records said. However, after that Nailing did not report back to the jail as required, according to the records.

Records in the case also say a "confidential source" notified police about seeing marijuana at Nailing's residence, leading to the search of his home where the drugs were found.

Nailing then told police he received the marijuana from another person in order to sell it but then had "reservations" and hid it in his residence instead.

His sentencing hearing in the animal cruelty case is still scheduled for June 9.

If Nailing is ultimately convicted in the marijuana case and receives prison sentences for both convictions, the two prison terms would have to be run consecutively.

The charge in the new case, possession of cannabis with intent to deliver, can bring a prison sentence of three to seven years. However, Nailing is eligible for a maximum of 14 years because of a 2010 conviction for having marijuana planned for sale.

The animal cruelty offense can result in a prison sentence of one to three years. Prison time isn't required for the charges in either case.

After his arrest for the marijuana offense, Nailing was jailed with his bond set at a level that required $2,000 posted for released.

During a court hearing earlier this week, Coles County Circuit Judge Brien O'Brien ordered a new arrest warrant for Nailing and set an additional $3,000 bond.

MICHIGAN -- A man recently paroled after spending 38 years in prison for killing a person is now accused of slitting his dog's throat and throwing the body, along with its collar and leash, into a trash can.

Terrance Mathis, a 65-year-old Kingston man, was arraigned Wednesday, March 8, on one count of killing or torturing an animal, according to the Tuscola County Sheriff's Office.

The charge is a felony punishable by up to four years in prison and could carry 500 hours of community service, prohibition from owning animals and a fine of $5,000.

The charge stems from a Feb. 21 incident in which a pit bull was found dead with its throat cut in a garbage can on White Creek Road near Mayville Road in Koylton Township.

The dog's jaw was taped shut, likely to prevent it from biting its killer, Tuscola County Undersheriff Robert Baxter said.

The tan-and-white pit bull was around 5 years old when it was killed. The dog was neutered, healthy and had a good weight, police said.

Police were lead to Mathis by an anonymous tip given to them shortly after the sheriff's office sought the public's help, Baxter said.

The dog's exact cause of death has not yet been determined. An autopsy for the dog has been scheduled.

Mathis was sentenced in a Macomb County court in July 1977 to life in prison for a homicide the year before.

He spent 38 years in prison before he was paroled in August 2015. He was set to be released from supervision in August 2019.

Washington: Police identify man - Vatentin Patricio - who threw newborn Chihuahua puppies into dumpster to die

WASHINGTON -- Pasco police now share the name and photo of the man who dumped three newborn Chihuahuas in a car wash trash bin about a week ago.

The animal shelter and police used surveillance video to identify the man as 33 year old Vatentin Patricio from Kennewick.

Officers tell Action News they've cited him with three counts of animal cruelty.

The shelter also says they're going to request the prosecutors to up the charges to a felony.

Officials haven't set a court date yet but police say the man isn't in custody.

The shelter says the suspect had to bring the mom and the one other puppy they still had.

The two will be held at the animal shelter until his court case.

New York: Someone beat a small dog and then dumped her into a trash can to die

NEW YORK -- A building superintendent in New York City made a grisly discovery while taking out the trash on Monday morning.

Upon opening a garbage bin outside his building, the super found a small white dog with a cut above an eye and injuries to its hind legs, according to a spokesman for the New York Police Department.

 

The superintendent of the building believed the dog was badly abused and left for dead in the trash, ABC station WABC in New York reported.

Gladys Vazquez, a resident of the building, told WABC that she and other residents gave the dog blankets and food before police arrived.

The dog has been placed in the care of the American Society for the Prevention of Cruelty to Animals, an NYPD spokesman told ABC News today. Police are investigating the incident as a case of animal cruelty. No arrests have been made in connection to the case as of this afternoon.

The rescued dog is estimated to be about 2 years old and is a female Maltese, the ASPCA told ABC News in a statement today.

The pup is being treated at the ASPCA Animal Hospital in Manhattan, but it is "too early to share a prognosis," the ASPCA added. Anyone with information is encouraged to contact the NYPD.

Michigan: Kittens found dead in trash and under bed; other animals rescued from hoarding. Adam Brege, 32, charged with animal cruelty

MICHIGAN -- A Muskegon homeowner faces animal cruelty and drug charges after a former tenant found dead kittens in a trash bin outside the house.

Adam Brege, 32, is charged with one animal cruelty misdemeanor and a 2-year felony for marijuana possession, due to a prior 2006 conviction. He's out on $8,000 bond.

Monday night, police and animal rescuers responded to Brege's home on the 1700 block of Jarman Street after a former tenant found four dead kittens in the trash.

Inside the home police say they found "excessive animal waste," and no food or water for the animals.

 

 Then, inside a bedroom they found seven cats and one dog alive, marijuana lying out in the open and another kitten under a bed, dead.

Brege admitted the animals and drugs were his, according to court documents.

Thursday, FOX 17 checked in on the seven cats rescued who are now on the road to adoption at Pound Buddies in Muskegon. Volunteer Marcia Lipps says they are set to be spayed and neutered Monday and if all goes well, they will be available for adoption next Friday.

 

 

"They're a lot more comfortable," said Lipps. "Easy enough to treat, none of them were in desperate shape."

Brege's neighbor Janice Sturm told FOX 17 it was a smelly hoarding situation.

"At first I just figured with all the cats in there it's starting to smell like a litter box, but then a couple of times, I don't know if the wind blew just right or what, that it was just like really overpowering," said Sturm.

"They were from a situation where they didn't know litter boxes, they didn't know blankets, they didn't know that water dishes were supposed to stay upright," said Lipps. "They're getting better."

Brege will be back in court for his probable cause hearing Aug. 11.

United Kingdom: Police searching for person who threw emaciated dog into dumpster to die

UNITED KINGDOM -- A dog was dumped in a bin in Dundee and left to die.

The Scottish SPCA was alerted when a member of the public noticed the dog while disposing of their rubbish at Dundonald Street on Friday morning.

The male pointer mix was severely malnourished, dehydrated and was unable to stand.

He was immediately taken to a vet, who decided that the kindest and only humane option was to put him to sleep due to the severity of his condition.

  

 

Abandoning an animal and causing unnecessary suffering are offences under the Animal Health and Welfare (Scotland) Act 2006. Anyone found guilty of doing so could be banned from keeping animals for a fixed period or life.

United Kingdom: Susan Maude, 62, charged with animal cruelty after zipping kittens into laundry bag and dumping them to die

UNITED KINGDOM -- These are the five kittens left abandoned in a zipped up laundry bag full of eight cats that were callously abandoned by their owner just minutes from her home.

CCTV cameras recorded Susan Maude, leaving her former home in Tranmere, Merseyside, at just after midnight on August 6 carrying the bag.

At 12.41am, Maude, 62, was caught on camera again returning to the address without the bag, which was later discovered abandoned by nearby wheelie bins.

Inside were five kittens and three adult cats Polly, Dolly and Dylan, which she left cramped and defenceless in the middle of the night, Wirral magistrates heard.

Maude, who now lives in Normanton, Yorkshire, was charged with failing to ensure a suitable environment for the kittens and a dog named Rusty, who she let loose and left to fend for himself.

She was also charged with failing to protect them from pain, suffering, injury or disease by dumping the cats and abandoning the dog.

A warrant was issued for her arrest after she did not attend court and was found guilty in her absence.
Wirral RSPCA Inspector Anthony Joynes said CCTV cameras owned by people in the street were crucial to the case - and thanked members of the public for raising the alarm.

He said: 'A member of the public rang a cat rescue charity and asked them to come out and collect an animal. When they got there they discovered a cat popping its head out of a bag and found there were three adult cats and five kittens inside.

'They were dumped in a place where they were unlikely to be found - a car park next to some wheelie bins - in the middle of the night and in my opinion it was like they were left with the trash. She has then moved 100 miles away without a care in the world for them.'

Inspector Joynes added: 'We're very lucky that we didn't end up with a bag full of dead cats. It was a hot August day and they weren't found until early afternoon. They must have been scared and stressed but luckily they've come into the RSPCA's care and they now have new homes.

'We're also lucky that members of the public who live in the street have their own security cameras and I've got to thank them.'

Tennessee: Lebanon police chief Mike Justice says there's nothing he can do about an owner using a plastic trashcan as a dog house.

TENNESSEE -- A controversy is brewing in Lebanon over how dogs are being cared for.

City leaders pride themselves on being proactive when it comes to animal safety, but some citizens have complained, saying the city is not doing enough to safeguard abused.

On Tuesday morning, News 2 was there as Lebanon Animal Control officers returned to a home on Tater Peeler Road for the fifth time after numerous complaints regarding alleged animal abuse.

Upon arrival, officers found the dogs in question were chained up, which is a violation of Lebanon’s city ordinance.

 

 

The dogs did have food, water and shelter, which consisted of a garbage can and barrel both laid on their sides.

Interim Police Chief Mike Justice said their shelter is considered adequate under state law.

“The City of Lebanon has enacted its own ordinances that are tougher than state law, but if a homeowner is not in violation we can’t hop a fence and recover their dog, and there are folks who believe it is not adequate,” Justice said.

I'm not saying seize the dogs and charge them with animal cruelty (at the state level)... Why not issue a civil town ordinance citation and let a judge decide whether or not it's adequate? It says right in their town laws that the owner must provide "adequate shelter". Why not get a veterinarian willing to say that in bitter winter temperatures it's NOT adequate? I don't accept someone like this police chief telling me he can't.

Late Tuesday morning, the case took a positive turn when the property owner voluntarily surrendered two of three dogs to the city.

One of the dogs is a puppy, which Animal Control officers say is underweight. The other is a 3-year-old female that seemed happy to go with them.

Conditions for a third dog were also improved with a new dog house and pillow.

“Are the conditions perfect? No, but state law doesn’t allow us to violate the man’s rights,” Justice said.

 

The confiscated pups will be thoroughly checked out before being placed up for adoption.

Frost-covered dog has to be put to sleep after cruel owner leaves it to die in a Michigan garbage can

MICHIGAN -- A young Pomeranian-mixed dog met a tragic end after being found frost-covered in a Michigan garbage can Monday.

The black and brown colored dog was found around 8:15am on the east side of Detroit.

The Michigan Humane Society (MHS) said in a statement that the dog was left to die in the trash can.

'It was obvious that someone put the dog in the trash can - there is no way he got in there by himself,' Debby MacDonald, MHS chief cruelty investigator said.

'It's unacceptable, and it needs to be unacceptable to us as a community.'

Someone who saw the dog in the garbage can and was unsure if it was still alive called the MHS Rescue Department.

Once they arrived on scene, officials said the dog was covered in frost, not moving and barely holding onto life.

Officials wrapped the dog in a blanket and rushed him to the MHS Detroit Center for Animal Care to receive immediate medical attention.

However, despite the veterinary team's best efforts to help the dog, 'he was suffering too great', according to the MHS statement.

Officials made the decision to end his suffering and he was humanely euthanized.

MacDonald said the MHS is offering a $2,500 reward for information leading to the arrest and conviction of the individual(s) responsible for leaving the dog in the garbage can.

'We need to be a voice for these animals, we need to take action to make sure this doesn't happen again,' she said.

RIP sweet baby

'While we are devastated by this tragedy, we need to make sure the person who is responsible for this is brought to justice.'
